1. Agreement and provider

These Terms of Use govern use of the Brief Clear iOS application and associated website. The provider is Neo Schulz, Schleusenstraße 4c, 16225 Eberswalde, Germany. By downloading, accessing, or using Brief Clear, the user agrees to these Terms and to any applicable Apple App Store terms.

Unless a separate custom license is expressly provided, Apple’s Standard Licensed Application End User License Agreement applies to the app. These supplemental Terms address Brief Clear-specific functionality, subscriptions, and limitations.

2. Description of the service

Brief Clear allows users to scan or import document images, perform text recognition, generate summaries and action items, detect possible deadlines, organize documents, schedule local reminders, and optionally add dates to Apple Calendar. Available functionality may depend on the device, iOS version, language, permissions, subscription status, and technical availability.

The developer may improve, modify, suspend, or discontinue features where reasonably necessary, including for security, legal compliance, compatibility, or product development.

3. Eligibility and user responsibility

Users must have legal capacity to use the service and enter into purchases. Minors may use Brief Clear only where permitted by applicable law and with any required consent of a parent or guardian.

Users are responsible for the documents they scan or import, for having the necessary rights to process them, for protecting their device, and for independently checking all important information.

4. Brief Clear Pro subscription

Brief Clear may offer an automatically renewing subscription called Brief Clear Pro. The current price, billing period, trial availability, and exact benefits are displayed in the app and in the Apple purchase confirmation interface before purchase. StoreKit and the App Store are the authoritative source for localized pricing and eligibility.

4.1 Free trials and introductory offers

A free trial may be offered only to users Apple determines to be eligible. Trial length and availability may vary by storefront or account. Unless canceled before the trial ends, the subscription automatically converts to a paid subscription at the displayed price.

4.2 Renewal and billing

Subscriptions renew automatically for the selected billing period unless auto-renewal is turned off through the user’s Apple account within the period specified by Apple. Apple charges the user’s Apple account and handles payment, taxes, billing, refunds, and renewal.

4.3 Cancellation and restoration

Subscriptions can be managed or canceled in Apple account settings. Cancellation stops future renewal but normally does not end access before the current paid or trial entitlement expires. Purchases may be restored through the app where supported. The developer cannot directly cancel an Apple subscription on the user’s behalf.

4.4 Changes

Prices or subscription benefits may change subject to Apple’s rules and applicable law. Any required notice or consent will be provided through the relevant Apple process.

5. Automated results and no professional advice

Text recognition, summaries, classification, extracted amounts, detected deadlines, and action items are generated automatically and may be wrong, incomplete, delayed, or based on an incorrect interpretation. Users must always consult the original document before acting.

Brief Clear does not provide legal, tax, financial, insurance, medical, immigration, or other professional advice. No output creates an attorney-client, tax-adviser, financial-adviser, or similar professional relationship.

The user remains solely responsible for meeting deadlines, making payments, responding to authorities or contractual partners, and obtaining qualified advice where needed.

6. Reminders and calendar entries

Notifications and calendar entries are convenience features. Delivery may fail or be delayed because of permission settings, device conditions, Focus modes, operating-system behavior, deleted data, changed time zones, or other factors. Users must not rely on Brief Clear as the sole method of tracking a legally or financially important deadline.

7. Local storage and backups

App content is primarily stored on the user’s device. Users are responsible for maintaining appropriate device backups where desired. Deleting app content, deleting the app, resetting the device, or changing backup settings may lead to permanent data loss. The developer generally cannot restore locally deleted documents.

8. Acceptable use

Users may not misuse the app, attempt unauthorized access, interfere with security mechanisms, reverse engineer the app except where expressly permitted by mandatory law, use the app to violate third-party rights, or process content unlawfully.

9. Intellectual property and license

Brief Clear, its design, software, branding, graphics, and original content are protected by applicable intellectual-property laws. Subject to these Terms and Apple’s applicable license terms, users receive a limited, personal, non-exclusive, non-transferable, revocable license to use the app on supported Apple devices for lawful purposes.

Users retain rights in documents they lawfully import. No ownership of user documents is transferred to the developer merely by using the app.

10. Apple and third-party services

The app depends on Apple technologies and services, including iOS, the App Store, StoreKit, device permissions, and optional calendar or notification services. Apple and other third parties operate under their own terms and privacy policies. The developer is not responsible for services outside the developer’s reasonable control.

11. Availability and updates

The app is provided on an “as available” basis. Temporary interruptions, compatibility changes, defects, or feature limitations may occur. Updates may be required for security, functionality, or compatibility. There is no guarantee that every feature will remain available indefinitely.

12. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by mandatory law, including liability for intent, gross negligence, injury to life, body, or health, or mandatory consumer rights.

To the extent legally permitted, liability for ordinary negligence is limited to breaches of essential contractual obligations and to foreseeable, typical damage. The app is not intended to be the sole safeguard against missed deadlines, incorrect payments, legal consequences, or loss of documents.

13. Termination

Users may stop using the app at any time. The developer may restrict or terminate access where required by law, necessary to protect the service, or caused by a material breach of these Terms. Subscription cancellation must be completed through Apple.

14. Governing law and consumer rights

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, to the extent this choice does not deprive consumers of mandatory protections available in their country of habitual residence.

For consumers, statutory jurisdiction rules apply. Mandatory consumer rights remain unaffected.

15. Changes to these Terms

These Terms may be updated where reasonably necessary, for example to reflect product, legal, or security changes. Material changes will be communicated where required. Continued use after an effective update is subject to applicable law.
